Pocahontas County Release Meanings
A release entry describes a custody movement. It does not always describe the end of a case or sentence. A Pocahontas County arrest may lead to custody at Tygart Valley Regional Jail and Correctional Facility in Belington. A state sentence may lead to Denmar Correctional Center and Jail or another WVDCR prison. The terminal entry could show bond, recognizance, dismissal, time served, probation, parole, sentence expiration, mandatory supervision, or transfer. Escape, hospitalization, and death also remove a person from an ordinary active list, yet none should be called a community release.
The agency that created the event holds the best record. WVDCR controls its jail and prison booking, OIS movement, time-sheet, and institutional release records. The Pocahontas County Sheriff’s Office may hold its arrest, incident, transport, or photo records. Circuit Court and Magistrate Court preserve the orders that explain bond, dismissal, sentence credit, probation, and other legal authority. These records answer different questions, so a sound check separates physical movement from legal cause.
- Discharge
- The end of custody or, when stated, the end of a sentence or supervision term.
- Parole
- Release from confinement under conditions while a sentence continues.
- Probation
- Court-ordered community supervision that is not the same as parole.
- Transfer
- Movement to another custodian, facility, or government authority, not freedom from custody.
Pocahontas County Release Types
The exact movement label matters. A court order can authorize an exit, but WVDCR’s movement entry shows whether and when institutional staff carried it out. The following distinctions prevent a roster change from being read too broadly.
| Release or movement | What it means | Best confirmation |
|---|---|---|
| Bond or recognizance | Jail custody ends while the criminal case may continue. | Court bond order plus WVDCR terminal movement |
| Time served or dismissal | A signed order may support release if no other hold exists. | Operative court order plus actual exit entry |
| Parole or mandatory supervision | Institutional confinement ends under ongoing conditions. | Board or sentence record, WVDCR movement, and Parole Services |
| Sentence discharge | The record states that the sentence or supervision has ended. | Final time sheet or discharge certificate |
| Transfer | Another jail, prison, federal agency, or ICE receives custody. | Sending movement and receiving-agency record |
A paid bond is not an acquittal. A parole grant is not the same as walking out that day. Likewise, a transfer from Tygart Valley to a state prison means the person remains confined. Use the source’s own words and preserve its date label.
Note: “Released from Tygart Valley” should not be expanded to “released to the community” unless the destination confirms that result.
Pocahontas County Release Record Fields
A useful Pocahontas County release record ties the end of custody to the correct admission. Full name, date of birth, aliases, and an offender identification number help distinguish people with similar names. WVDCR Policy Directive 151.00 explains that OIS keeps the OID across prior incarcerations. That stable number is often more useful than a spelling alone.
| Field | What it shows |
|---|---|
| Full name, birth date, aliases | Identity information used to avoid a false match |
| OID or booking number | The link between admission, prior custody, and movement records |
| Institution and admission | Which WVDCR placement held the person and when that custody began |
| Actual release date and time | The completed terminal movement, when the precise timestamp is available |
| Method or movement type | Bond, discharge, parole, transfer, or another stated reason |
| Destination or receiving agency | Whether the person entered the community or another authority took custody |
| Time sheet or certificate | The sentence calculation or formal discharge record for a state sentence |
A projected release date is not an actual release field. WVDCR calls the underlying calculation the minimum discharge or final release date and revises it when jail credit, lost or restored good time, extra credit, or a corrected court order changes the math. Ask for both the then-current projection and the completed movement when the distinction matters.
Request Pocahontas County Release Records
West Virginia’s Freedom of Information Act provides the records-request route when public screens are incomplete. Send the request to the creator of the record. For Tygart Valley or Denmar custody, address WVDCR and name the facility, person, OID if known, and a narrow date range. Ask the Sheriff only for Sheriff-created arrest, incident, transport, or photo material. Ask the proper court clerk for signed orders and docket records.
- Identify the person with full name, date of birth, aliases, and OID or booking number when known.
- Name the facility and bounded dates. Request the admission record, chronological movement history, release screen, actual release date and time, method, and destination.
- For a prison sentence, add the current and prior time sheets, release checklist, order, and releasable discharge certificate.
- Request electronic delivery. Ask that nonexempt portions be produced with redactions and that any denial cite the specific exemption.
- Compare the response with the court order. Follow up if it shows authority to release but omits the completed terminal movement.
Under West Virginia Code §29B-1-3, the custodian must act as soon as practicable and within five days, excluding weekends and legal holidays, by producing records, arranging inspection, or issuing a written reasoned denial. Actual reproduction cost may be charged, but search, retrieval, or staff-time fees may not. No verified local copy rate or walk-in schedule was found, so call before travel and request a cost estimate.
Pocahontas County Release Record Law
West Virginia Code §29B-1-1 states the access policy, while §29B-1-2 defines public records broadly enough to include photographs. Access is not absolute. Section 29B-1-4 supplies exemptions that can cover private information, investigative material, security information, juvenile matters, and records sealed or expunged by court order. A focused request for segregable release facts is more effective than a demand for an entire offender file.
Retention is not a single public 24-hour, 48-hour, or 72-hour rule. The daily jail view is an active snapshot. Internal OIS records and court files persist under other rules, while public access can change after sealing or expungement. Request archived movement data by person, facility, and date range instead of assuming a missing web result has been erased.
Find Pocahontas County Released Inmates
The strongest search begins with custody classification. A Pocahontas arrest or local jail sentence belongs first in WVDCR’s Jails search. A state-prison sentence belongs in the Prisons search. A federal term belongs in the BOP locator, while an ICE search is relevant only when immigration custody may have followed WVDCR.
- Search the official WVDCR Offender Search hub by full name. Save the access time, spelling, OID, facility, status words, and displayed dates.
- Compare the name with the daily county or institution view. Describe absence only as not found in that active snapshot.
- Use the West Virginia Court Record Access hub to find the matching Pocahontas case and operative order.
- Check VINE for a status change or register for notice. Treat it as corroboration, not a certified movement log.
- For parole or a prison discharge, confirm the Board result, WVDCR actual movement, time sheet, destination, and supervision separately.
- When screens remain unclear, request the admission and terminal movement from WVDCR.
A person searched by name can be distinguished from the same-day feed question covered by the Pocahontas County 24-Hour Releases. The named-person path uses identity, custody, court, and movement records together.
WVDCR Pocahontas County Release Search
WVDCR separates Daily Incarcerations, Offender Search for Jails, Offender Search for Prisons, and Escapees and Absconders. The split is crucial. Tygart Valley custody for a local Pocahontas matter is normally a jail search. Denmar and other prison terms call for the prison interface. The absconder list is an exception tool and cannot prove that someone has completed supervision.
The prison result may use “Projected Release Date,” while policy uses “minimum discharge/final release date.” Record the label exactly. A parole or supervision status may support release from confinement without proving final sentence discharge. OIS also warns that public information may not reflect the true current location, release date, or status, so the responsible office remains the source for a certified historical answer.
Note: Preserve “projected,” “actual,” “transfer,” and “discharge” as separate labels when saving or describing any WVDCR result.
Pocahontas County Recent Release Gap
No official rolling Pocahontas County 24-hour or 72-hour released-person feed was found in the Sheriff or WVDCR interfaces reviewed as of the research date. WVDCR’s daily incarceration and admission pages show active or daily custody data. They are not release archives and must not be renamed as such.
For a recent event, save an OIS result with its timestamp, check the court docket, search or register with VINE, and contact Tygart Valley or WVDCR for the terminal movement. Ask whether the outcome was community release, parole, mandatory supervision, transfer to another prison, federal or ICE custody, hospitalization, escape, or death. Cadence, retention, and release-feed fields remain not publicly established.
Pocahontas County Release Orders
Pocahontas County Circuit Court preserves felony disposition and sentence orders. Magistrate Court covers misdemeanors, initial bond proceedings, and preliminary felony matters. Search circuit cases through WVPASS and magistrate matters through the state Magistrate Case Record Search, both reached from the Judiciary’s access hub. Then validate key entries with the clerk, since online records may be incomplete.
A bond order establishes authority, not the gate time. A prison commitment describes continued custody. A time-served order supports a reason for release, but another case, warrant, parole detainer, federal writ, or immigration detainer can prevent a community exit. Match the order to WVDCR’s movement before treating the legal event as a completed release.
The West Virginia Judiciary starting point appears below.
Circuit and magistrate routes serve different case levels, while clerk confirmation resolves ambiguous docket labels.
Pocahontas County Release Status
Choose the record by the question being asked. Current custody, legal authority, actual movement, post-release supervision, and federal custody are separate facts.
| Question | Primary channel | Key limit |
|---|---|---|
| Is a local detainee still held? | WVDCR Jails search and daily view | Absence does not prove release |
| Why could custody end? | Pocahontas court docket and signed order | Order time is not exit time |
| When and how did custody end? | WVDCR terminal movement or release record | Transfer must be distinguished from community release |
| Is state supervision active? | Parole Services, Board record, or sentencing court | Parole and probation are different systems |
| Did federal prison custody end? | BOP Inmate Locator and federal docket | “Not in BOP custody” does not rule out another custodian |
VINE adds a useful notice layer for participating West Virginia custody. It can report a change, but source-system lag and transfer handling prevent it from serving as an exact gate clock.
Getting Home After Pocahontas County Release
Rural release travel spans two places. Tygart Valley Regional Jail, the main jail-custody route for Pocahontas County, is in Belington. Mountain Transit Authority’s documented Pocahontas County service is limited-day local service and does not establish a pickup at the Tygart Valley gate. A family should confirm the actual facility, expected exit, pickup point, and permitted timing before leaving for Belington.
MTA can be reached at 304-872-5872, while Tygart Valley’s published number is 304-637-0382. The transit route is not a jail-release shuttle. A projected date, court order, or parole grant can precede processing, so travel plans should rest on facility confirmation rather than an assumed release hour.
Pocahontas County Release Day Reporting
The Pocahontas County Day Report Center in Marlinton is part of the community-corrections landscape. It is not a detention site and should not be searched as a jail. The center and its Community Criminal Justice Board are distinct from WVDCR Parole Services and from probation administered through the West Virginia Judiciary.
Mountain Transit Authority’s Marlinton loop lists the Day Report Center as a stop. That route fact may help with local appointments, but it does not show that a person is on parole, probation, or any other status. Verify parole through WVDCR Parole Services. Verify probation through the sentencing court and authorized Judiciary channels.
Note: Participation in a day-report or community program does not, by itself, establish the legal form or duration of supervision.
Pocahontas County Release Property
Property and identification can require quick follow-up after a Pocahontas County release. WVDCR’s jail-admission form warns that property left behind after release will be disposed of after 30 days. Policy Directive 151.00 also says identification may be held in the legal file pending release and that the file can contain release orders, certificates, and checklists.
Contact the releasing facility promptly and identify the person, OID or booking number, and release date. Ask for the facility’s pickup procedure rather than mailing items or arriving without notice. The court clerk holds the underlying order, while WVDCR holds institutional property and release-file material. Each request belongs with the office that created or retained it.
Pocahontas County Release Geography
The county’s map reverses a common assumption. Pocahontas County detainees are generally served by Tygart Valley in Randolph County, while Denmar, a state prison and jail, sits inside Pocahontas County. A person at Denmar may have no Pocahontas prosecution. A person charged in Pocahontas may never be held at Denmar.
Search sentencing or committing county, arresting agency, and physical institution as separate facts. The Sheriff can hold an arrest record while WVDCR holds the custody movement. A court can explain the legal cause while the person is confined in another county. This division is why a search for a building called “Pocahontas County Jail” can miss the real record custodian.
Pocahontas County Release Records After Expungement
Expungement can explain an empty court search. Under West Virginia Code §61-11-26, a granted petition leads the clerk to seal the matter, redact index references, and remove public electronic court data. The clerk then answers a qualifying inquiry as though no record exists. Eligibility and waiting periods depend on the case, and current Judiciary forms control the process.
A missing public case result therefore cannot prove that no arrest, custody, or release occurred. Juvenile and other confidential matters create similar limits. Do not try to reconstruct a sealed event from weak copies. For an accessible record, use the responsible clerk and WVDCR. For an expungement question, rely on the statute, current forms, and legal counsel where needed.
Pocahontas County Release Facilities
The relevant network includes custodial facilities, courts, arresting agencies, and federal systems. The first entry is the primary jail route for Pocahontas detainees. Each link explains the correct release proof for that office or system.
- Tygart Valley Regional Jail and Correctional Facility: regional-jail custody, with releases confirmed through Jails OIS, VINE, court, and WVDCR movement records.
- Denmar Correctional Center and Jail: in-county state prison and jail whose prison releases use WVDCR sentence, parole, and discharge records.
- West Virginia DCR regional-jail system: statewide active jail data and historical movement records.
- Pocahontas County Sheriff’s Office: arrest, incident, transport, and Sheriff-held photo records.
- Pocahontas County Circuit Court: felony disposition, sentence, and later orders.
- Pocahontas County Magistrate Court: misdemeanors, initial bond, and preliminary matters.
- Federal Bureau of Prisons system and ICE / Enforcement and Removal Operations: separate federal custody paths, neither of which is a county release ledger.
No single portal supplies a universal custody history. Start with the system that held the person, then corroborate the actual movement and legal authority.
